Cases Delmastro and Santanchè, P. Chigi against the judges: the judiciary does not engage in politics

After days of silence on the events related to Daniela Santanchè, when the news of Delmastro’s forced indictment arrived, the executive decided to react and send a message: magistrates shouldn’t think of engaging in politics. These are “intimidating tones”, attacks the secretary of the Democratic Party, Elly Schlein, “unacceptable” in a democracy. The leader of the M5s, Giuseppe Conte also reacts: this is “a shameful attack”

A frontal attack on the judiciary. At least to that part that seems to be “opposing” in view of the “European” elections. After days of silence on the case of Daniela Santanchè, when the news of Andrea Delmastro’s forced indictment arrived, Palazzo Chigi decided to react. It is Prime Minister Giorgia Meloni who is official, albeit in the form of “sources”, the message that the government sends to the magistrates: let them not think of engaging in politics, the executive will not be intimidated and will go ahead with numbers. For the entire term. These are “intimidating tones”, attacks the secretary of the Democratic Party, Elly Schlein, “unacceptable” in a democracy. The leader of the M5s, Giuseppe Conte also reacts: this is “a shameful attack”.

The Delmaster case

The executive’s reaction came after, on 6 July, the investigating judge of Rome ordered the compulsory indictment of the Undersecretary of Justice Andrea Delmastro, under investigation for disclosure of official secrecy in relation to the Cospito case, the anarchist detained to 41 bis. The judge rejected the request for dismissal made by the prosecutor who will now have to formulate a request for indictment against the deputy of the Brothers of Italy and undersecretary of state for justice.

The position of Palazzo Chigi

The first observation that moves Palazzo Chigi is that it is not “usual” for “the public party to ask for it to be dismissed and the judge for preliminary investigations to order that proceedings begin”. Everything revolves around the Delmastro case, with the prime minister locking him up, after having already defended him when the Cospito case broke out. Then, also including the Santanché case in the speech, Palazzo Chigi’s thinking is the following: when two episodes such as the forced indictment and information that ended up in the “outlawed” newspapers concern “two government officials, it is legitimate to ask whether a section of the judiciary has chosen to play an active opposition role, and has thus decided to inaugurate the electoral campaign for the European elections prematurely”.
