Dear petrol, the fuel decree is in force: all measures

Among the new features is the extension of petrol vouchers up to 200 euros, the return of mobile excise duty and the obligation for managers to display the average price

Fuel decree in force from today. The text, published in the Official Gazette, contains urgent provisions on the transparency of petrol and diesel prices and the strengthening of the control powers of the Guarantor for price surveillance, as well as support for the use of public transport. Here are the measurements point by point.

BILLBOARDS WITH PRICES – The decree introduces a new transparency regime for the sale of fuels through the identification of a average national price to be displayed to distributors. Managers will therefore be obliged to display the average national price of fuel next to the selling price, in each petrol station. The price will be calculated daily by the Ministry of the Environment and communicated on the ministry’s website. Within fifteen days from the date of adoption of the decree, merchants will have to adjust the price advertising billboards at each point of sale, including those along the motorway network.

SANCTIONS – In case of violation of the provisions, the decree establishes, the pecuniary administrative fine from 500 to 6,000 euros. After the third violation, the suspension of the activity can be ordered for a period from 7 days up to 90 days. The verification of the violation is carried out by the Guardia di Finanza. The Prefect provides for the imposition of sanctions. A share equal to 50% of the administrative sanctions applied will be paid into the State budget and reassigned to Mimit “to be used for the implementation of the IT and telematic infrastructure for the detection of fuel prices” and “for initiatives in favor of consumers aimed at to promote price transparency” and “to spread knowledgeable and informed consumption”

A share equal to 50% of the administrative sanctions applied for the violations of the obligations referred to in paragraph 2 is paid into the State budget and reassigned to a specific chapter entered in the estimates of the Ministry of Enterprises and Made in Italy, for be destined for the implementation of the IT and telematic infrastructure for the detection of fuel prices, as well as initiatives in favor of consumers aimed at promoting the transparency of fuel prices and spreading aware and informed consumption.

MOBILE EXCISE – The decree provides for the green light to reactivation of the mobile excise system introduced by the 2008 budget law. The cut in excise duties can be adopted if the price “increases, on the average for the previous two-month period, with respect to the reference value, expressed in euros, indicated in the last economic-financial planning document presented”. The decree also “must take into account any decrease in the price compared to that indicated in the economic-financial planning document, on average for the previous quarter”.

PRICE SURVEILLANCE – More powers to Mr. Prices. The published decree provides for the “strengthening of the powers of the guarantor for price surveillance“, which “where necessary for the purpose of its surveillance interventions on the territory, works in connection with the observatories and with the regional price offices, counters or similar names, if established by regional law”. Furthermore, “makes use of the collaboration and the data collected by Istat which are made available to the Guarantor for price surveillance upon specific request”.

Then comes one new Commission of alert. “In order to monitor the dynamics of the prices of consumer goods deriving from the trend of the costs of energy products and raw materials on the international markets, the Commission for rapid alert surveillance is set up, without new or greater burdens for public finance The Guarantor – reads the text of the decree – can convene the Commission to coordinate the activation of the monitoring tools necessary to identify the reasons for the anomalous dynamics of prices on the market chain. Commission are not entitled to fees, attendance fees, reimbursement of expenses or other emoluments however denominated”.

BONUSES – The fuel bonus of 200 euros is back for private sector workers. The bonus is for the purchase of fuel sold by private employers to employees, in the period from 1 January 2023 to 31 December 2023. “The value of petrol vouchers or similar securities for the purchase of fuel sold by employers of private work for employees, in the period from 1 January 2023 to 31 December 2023, does not contribute to the formation of the worker’s income, if the amount does not exceed 200 euros per worker” reads the text.

Also comes a 60 euro voucher for the purchase of season tickets for local public transport services, regional and interregional or for national rail transport services. The bonus is recognized in favor of natural persons who in 2022 achieved a total income not exceeding 20,000 euros, in order to mitigate the impact of high energy prices on families, in particular in relation to transport costs for students and workers.
