All those who have been affected by the repressive laws, have evaded military obligations, will benefit from it for students and scholars with expired visas, or who should return to Russia to receive the authorization to work in Italy
The “Russian dissent” bill presented today in the Chamber by Lia Quartapelle (Vice President of the Foreign Affairs Commission, Pd deputy), intends to intervene in support of all the “citizens of the Russian Federation at risk of persecution”, to facilitate their permanence and integration in Italy.
Article 1 explains precisely who will be able to take advantage of the regulations, i.e. “those who have evaded military obligations or are in any case at risk of being subjected to military obligations and for this reason have left the Russian Federation, those who are part or have a stable connection with organizations identified by the law on “foreign agents” or “extremists”; those who are subjected or risk being subjected to criminal proceedings for violation of articles 208 and 275 regarding participation in war on the side of the enemy and confidential collaboration with foreigners, 276 in matters of gathering and transmitting information to the enemy, 280, in matters of instigating actions against state security, 282 in matters of using extremist symbols, 284, in matters of collaboration with organizations unwelcome, of the Criminal Code of the Russian Federation; those who are subjected or risk being subjected to criminal proceedings for violations of the legislation of the Russian Federation on the dissemination of false or defamatory information about the armed forces; those who are subjected or are threatened with criminal prosecution for violations of the legislation of the Russian Federation on so-called gay propaganda; those who are subjected or are at risk of being subjected to criminal proceedings for participating in unauthorized demonstrations”.
Article 2 intervenes “on the specific situation of students and scholars from the Russian Federation with visas and residence permits that expired after 24 February 2022, the beginning of the ongoing conflict, and who do not intend to return to Russia because they risk persecution”.
The bill therefore introduces “the possibility of an extension of residence permits and visas until 30 June 2024, when the subjects demonstrate to the competent authorities that they fall within one of the cases of risk of persecution indicated in article 1”.
“For an evaluation of the elements produced – reads the proposal – the competent authorities request an opinion from the Ministry of Foreign Affairs, which obviously, through the diplomatic representation in Russia or through other channels, will be able to acquire information on the concrete situations of the applicants”.
Similarly, Article 3 deals with other Russian workers present in Italy. In some cases these are people who do not intend to return to Russia because they too are at risk of persecution but, at the same time, cannot sign a regular employment contract because, according to the Consolidated Law on Immigration “they should instead be , when submitting the application for clearance to work by the work, just in Russia”.
The article therefore takes up the general provisions of the procedure for simplifying the application for the no impediment document to work. In other words, “until 30 June 2024, the issuance of work authorization will be permitted even when Russian citizens are already present on the national territory and fall into one of the risk categories identified by article 1”. Also in this case, an opinion from the Ministry of Foreign Affairs is required as part of the investigation of the application.
Finally, article 4 of the text presented today refers to a decree of the Minister of the Interior, in agreement with the Minister of Foreign Affairs “the definition of the implementing rules of the law. The decree will obviously have to define in particular the procedure for verifying situations of risk “.
